Data Controller is DAUFOOD which is made up of the markets and sub-franchisees listed below. You can access detailed information on the different controllers by clicking on their Website and Privacy Policy:

  • Main objective of the Data Privacy Policy

This Privacy Policy establishes the bases on which DAUFOOD processes your information through DAUFOOD’s Job Portal (hereinafter, “Job Portal”).

The main objective of the Job Portal, which you can access through the following URL https://daufood.personio.de/login/index is to manage the relationship with employees and job applicants

Every time you use the Job Portal and provide us with your personal data, DAUFOOD will use it to identify you and to enable you to browse the Job Portal and make use of the services it offers. This service may include registering as a user, registering as a candidate for a job offer, subscribing to receive job offers, sending queries through the contact form, etc.

The Privacy Policy will vary according to the version that is in force at the time you access the Job Portal. You should ensure that you always review the Privacy Policy, to verify that you agree with it.

  • What personal data does DAUFOOD collect from you?

Depending on the services and functionalities of the Job Portal that you use, we will need to process some data or other, which in general will be, depending on the case, the following:

- Your identification data (e.g., your name, surname, address, telephone number, etc.);

- Academic and professional data (education, etc.);

- Employment details (profession, professional background, etc.);

- Details of your professional interests and preferences.

When you fail to provide certain information marked as mandatory, it will not be possible to manage your registration as a user or even your application to job offers available at the Job Portal.

Important notice about the content of the additional information provided:

It is very important that the information you provide us through free text fields, as well as in the attached files, links or documents provided, do not contain confidential or especially sensitive information, such as:

  • racial or ethnic origin,
  • ideology or political, religious or philosophical convictions,
  • affiliation to political parties or trade unions,
  • physical or mental health,
  • biometric data or genetic configuration,
  • sexual orientation,
  • criminal record,
  • Social Security or personal identification number, etc.

If you provide us with this type of information, you do so at your own risk. However, in case we detect this type of information, we will proceed to delete it from our systems and in no case it will be taken into consideration for the selection processes you may apply to.



  • What are the purposes of processing your data and what does DAUFOOD use them for?

Depending on how you interact with the Job Portal, we will use your Personal Data for the following purposes:

a) Registration as a user of the Job Portal: We will use the Personal Data you provide to identify you as a user of the Job Portal and give you access to the different services, functionalities and applications available to you as a registered user.

We may also use your data to contact you via email, phone calls or SMS, in relation to updates of functionalities or informative communications related to the services, including security updates of the Job Portal.

b) DAUFOOD selection processes: We will use the Personal Data provided by you in the registration form of the Job Portal, as well as during the use of the services and functionalities of said Portal as a registered user, for the development, implementation and management of DAUFOOD's selection processes, depending on the areas of interest indicated by you and the existing offers to which you submit your application.

We may also contact you by e-mail, telephone call or SMS in order to properly manage the selection processes in which you wish to participate.

c) Accessory services or functionalities: In addition to the functionalities of the Job Portal, it also offers a series of specific functionalities or services that may be activated voluntarily by accepting the specific conditions:

i. Communications by e-mail, SMS or telephone: If you are interested, you may voluntarily select the possibility of receiving notices with information about job offers published on the Job Portal.

To do so, you will need to tick the box available in the Newsletter section, giving your consent to subscribe to our notification service and authorizing DAUFOOD to send you information about job opportunities whose selection processes are managed through the Job Portal and in accordance with the preferences you have selected.

These communications will be sent according to the preferences you have indicated to us through the Job Portal, including the sending of communications by e-mail or by any other equivalent means of electronic communication (such as SMS) as well as by telephone calls. You can change your preferences regarding the sending of such communications by accessing the My Account section or revoke your consent at any time through the My Account section, by checking the corresponding deactivation box.

d) Management of Inquiries: In the event that you ask us any question, via e-mail or the contact form, your Personal Contact Data may be used by DAUFOOD to respond to your requests, including those related to the technical service of the Job Portal, its operation, doubts/suggestions related to selection processes, etc.

In order to properly manage your queries, it may be necessary for us to contact you by e-mail, telephone call or SMS.

  • Where does DAUFOOD collect your personal data from?

The origin of the personal data that we process in the Job Portal may be any of the following:

  • Your direct interaction with the Job Portal itself, by completing the registration form and those specific forms that are available for the specific functionalities you wish to use.
  • Through a third party, in the event that you have authorized them to refer you and provide us with your contact details. This information may appear preloaded in the registration form on the Job Portal, and thus manage your registration as a potential candidate to participate in DAUFOOD's selection processes. Bear in mind, in cases in which the registration process on the Job Portal is terminated, we will inform the third party who provided us with your contact details of this circumstance. Likewise, if you do not register as a user within a certain period of time, we will delete your data.
  • What is the legal basis of the data processing?

The legal basis that allows us to process your Personal Data also depends on the purpose for which we use it:

  • Registration as a user of the Job Portal: the processing of your data is necessary for the execution of the conditions of use that regulate the use of the Portal.
  • DAUFOOD selection processes: The processing of your data is necessary for the execution of the conditions of use that regulate the use of the Job Portal.
  • Accessory services or functionalities:
  • Communications by e-mail, SMS or telephone: The basis of legitimacy that we have to use your data is the consent you give us by activating the box available in the Newsletter section.
  • Management of queries: We consider that we have a legitimate interest to respond to requests or queries that are raised through the means available to us for this purpose. We understand that the processing of this data is also beneficial to you insofar as it allows us to adequately address and resolve the queries raised.
  • For how long does DAUFOOD retain your personal data?

The retention period of your data will depend on the purposes for which we process it. Specifically:

  • Registration as a user of the Job Portal: we will process your Personal Data as long as your account remains active. In this regard, we inform you that your registered user account will expire after 18 months of inactivity (meaning, you have not logged in in 18 months). Before proceeding to delete your account, you will receive a reminder by email informing you how to proceed to prevent your account from expiring and therefore your data from being deleted.
  • DAUFOOD selection processes: DAUFOOD will process your Personal Data for as long as your candidacy remains active. In case you have not been selected to a position, but your profile is still active in the Job Portal, your personal data will keep being processed for 6 months since.
  • Ancillary services or functionalities: if you want to keep being subscribed to our Job Portal, your login data and profile will still be operating until you decide to unsubscribe or erase your data. However, after 18 months of inactivity, your profile data will be deleted, although previously we will ask you by e-mail if you’d like us to proceed with the erasure or not.
  • Communications by e-mail, SMS or telephone: DAUFOOD will process your data until you unsubscribe or cancel your subscription to the Newsletter.
  • Management of consultations: We will process your data as long as it is necessary to meet your request or request.

Since DAUFOOD processes your data for the time strictly necessary to fulfil its purposes, we will keep them duly stored and protected for as long as liabilities arising from the processing may arise, in compliance with the regulations in force at any given time. Once the possible actions in each case are prescribed, we will proceed to the deletion of the personal data.

  • Do we share any of your personal data with third parties?

To fulfil the purposes indicated in this Privacy Policy, it is necessary that we provide access to your personal data to DAUFOOD entities and third parties that support us in the services we offer you, namely:

  • DAUFOOD entities: given that one of the main objectives of the Job Portal is, to manage DAUFOOD's selection processes and maximize the opportunities of its registered users, it may be necessary for us to communicate or transfer the information you have provided us with to certain companies within DAUFOOD, to the extent that they need access to your personal data as they are directly involved in the selection processes to which you have applied or because it is necessary according to your interests and preferences.
  • Service providers: they give us, among others, support in technological issues or for the development, implementation and management of our selection processes.

It is possible that some of the collaborating entities are located in territories outside the European Economic Area that do not provide a level of data protection comparable to that of the European Union. In such cases, we inform you that we transfer your data with appropriate safeguards and always keeping your data in a secured way:

Personal data communicated to or accessed by DAUFOOD employees may be used and stored locally by the company for the purpose of managing selection processes.

  • What are your data protection rights?

We are committed to respecting the confidentiality of your personal data and to guaranteeing you the exercise of your rights. You can exercise them at no cost by writing us an email to our address myprivacy@daufood.com, simply indicating the reason for your request and the right you wish to exercise. If we consider it necessary to identify you, we may ask you for a copy of a document proving your identity.

Regardless of the purpose or the legal basis on which we process your data, you have the right to:

- Ask us for access to the data we hold about you. We remind you that if you are a registered user of the Job Portal you can also consult the information you provided to us when you created your account in the section corresponding to your personal data.

  • Ask us to rectify the data we already have: Remember that if you are a registered user of the Job Portal you can also access the personal data section of your account to modify or update your personal data available in your account. In any case, please note that by actively providing us with your personal information by any means, you warrant that it is true and accurate, and you agree to notify us of any changes or modifications to your personal information. Any loss or damage caused to the Job Portal or the person responsible for the Job Portal or any third party by reason of the communication of erroneous, inaccurate, or incomplete information in the registration forms shall be the sole responsibility of the user. Please remember that you should only provide us with your own personal data, not those of third parties, except as permitted in this Privacy Policy.
  • Ask us to delete your data: to the extent that they are no longer necessary for the purpose for which we need to process them as we have informed you above, or to the extent that we no longer have the legitimacy to do so.
  • Ask us to restrict the processing of your data: which means that in certain cases you may ask us to temporarily suspend the processing of your data or to keep it longer than necessary when you may need it.
  • If you have provided us with your consent to the processing of your data for any purpose, you also have the right to withdraw your consent at any time.
  • Where our legitimacy for processing your data is your consent or the performance of the conditions of use, as previously explained, you also have the right to request the portability of your personal data. This means that you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format, so that it can be transmitted to another entity directly, where technically possible. Moreover, when the processing of your data is based on our legitimate interest, you also have the right to object to the processing of your data.



Finally, we inform you that you have the right to lodge a complaint with the Data Protection supervisory authority responsible for data protection, especially with the local authority responsible for data protection. Find your National Data Protection Authority online.

  • Changes in the Data Privacy Policy.

We may change the information contained in this Privacy Policy from time to time. If we do so, we will notify you in a variety of ways through the this platform, or we will notify you at your email address when the change in question is significant to your privacy, so that you can review the changes, assess them and, if appropriate, object or unsubscribe to any service or functionality. In any event, we encourage you to review this Privacy Policy from time to time.

  • Confidentiality and Information about the Service Provider
  • Daufood applies security measures and makes reasonable efforts to maintain information confidentiality based on the best practice. Users are informed that Daufood is not responsible for the misuse to which registered users or third parties may realize, nor for the possible damages caused by human or technical errors in the use of the application.
  • The following rules are mandatory in the use of the Personio application:
  • Users must use the tool in compliance with Daufood Group Policies, especially in relation to the veracity of the data, the application of information security measures and respect for confidentiality.
  • Users must, in case of detecting a security breach, communicate it by using the established channels. Communication must be made within twenty-four hours after its detection.
  • Users shall respect and protect the confidentiality of confidential information and personal data to which they may have access to. In this sense, confidential information is understood to be all non-public information contained in the application or that expressly defined as non-confidential.
  • Likewise, users must refrain from using the referred information for purposes other than the authorized ones and to erase it when it is no longer necessary.
  • In any case, the user must notify immediately after discovering an unauthorized use or disclosure of Confidential Information or any other breach related to this clause.
  • Likewise, the data provided that is required from users will be protected respecting privacy and the principles of good faith.

Likewise, users are informed that this tool has been designed by Personio GmbH with address at Rundfunkplatz 4 80335 München (Deutschland). The supplier has signed the corresponding Data Processing Agreement according to art. 28 GDPR. In the event of unavailability of the service, Personio may access the stored data for the sole purpose of repairing the application and subject to prior authorization from Daufood.

      

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.
